This course looks at Clauses 5 and 6 of the FIDIC Red Book. These provisions cover:
- the rules around sub-contracting
- nominated subcontractors
- the rules regarding recruiting staff and the basis on which they should be paid and treated;
- working hours and facilities for staff
- key personnel, record keeping and removing Contractor’s Personnel from Site
The Sub-Clauses that makeup Clauses 5 and 6 are different from many of the standard forms that may be seen within the UK. However, it must be remembered that the FIDIC is designed for use around the world, including in jurisdictions where certain areas of law, such as health and safety and working conditions are not as prescriptive as they are in Europe. The clauses, while linked to local laws at certain levels, also work to ensure basic standards are met.
After completing this course, you should be able to understand:
- How Subcontractors are appointed and approved
- How nominated Subcontractors are dealt with
- What the contractual rules are around Key Personnel, superintendence on site and health and safety
- What records about staff, labour and materials need to be included in a progress report
- When the Engineer can order people to be removed from Site
