NEC4 ECS Contractor Notification Template

Use this free downloadable template to help you create a Contractor Notification under the NEC4 Engineering and Construction Subcontract (ECS). 

The ECS places great emphasis on effective communication between the parties and one of the ways it accomplishes this is by requiring one party to notify the other of certain events and circumstances.

You can use this NEC4 ECS template for a Contractor Notification of the following:

• Notify under clause 13.2 of an address to receive communications
• Notify under clause 13.5 of an agreement to extend the reply for a communication
• Notify under clause 14.2 of a delegation or a cancellation of a delegation
• Notify under clause 17.1 of an ambiguity or inconsistency
• Notify under clause 17.2 of an illegal or impossible requirement
• Notify under clause 25.2 of an assessment of the amount to be paid as the Subcontractor failed to provide services
• Notify under clause 25.3 of the amount assessed due to a failure to meet a Key Date
• Notify under clause 26.3 of an agreement that subcontract documents should not be submitted
• Notify under clause 27.2 to provide access to the work being done and Plant and Materials being stored
• Notify under clause 28.1 of an intention to transfer the benefit of the subcontract or any rights under it
• Notify under clause 54.3 of the preliminary assessment of the Subcontractor’s share (main Option C)
• Notify under clause 54.4 of the final assessment of the Subcontractor’s share (main Option C)
• Notify under clause 54.7 of the preliminary assessment of the Subcontractor’s share (main Option D)

For simplicity, you can also use this template for an ‘assessment’ under clauses 25.2, 25.3, 54.3, 54.4, 54.7, 54.8, 85.1 and X7.3, and ‘permission’ under clauses 70.2 and 72.1).
