NEC3 PSC Employer Instruction Template

Use this free downloadable template to help you create an Employer Instruction under the NEC3 Professional Services Contract (PSC).

The PSC gives the Employer wide ranging powers to issue instructions to the Consultant. Note, if an instruction will give rise to a compensation event, the Employer is obliged to notify the Consultant of the compensation event at the time of giving the instruction. That notification can be given by using form ‘NEC3 ECC Employer Notification’ 

You can use this NEC3 PSC template for an Employer’s Instruction to do the following:

• Instruct under clause 16.1 to resolve an ambiguity or inconsistency
• Instruct under clause 17.1 to change the Scope to remove something which is illegal or impossible
• Instruct under clause 18.1 on how to deal with a prevention event
• Instruct under clause 20.1 to change the Scope or a Key Date
• Instruct under clause 22.2 to remove a person
• Instruct under clause 24.4 to submit proposed contract data for a subcontract (main Options C and E)
• Instruct under clause 33.1 to stop or not start work, or to start or restart work
• Instruct under clause 34.1 to submit a quotation for acceleration
• Instruct under clause 40.3 to correct a failure to comply with the quality plan
• Instruct under clause 55.1 to carry out a Task (main Option G)
• Instruct under clause 60.2 correcting a mistake in the Task Schedule (main Option G)
• Instruct under clause 91.1 assign the benefit of a subconsultancy or other contract to the Employer
• Instruct under clause X12.1(4) providing Partnering Information
