An Overview of Dispute Resolution W2 under NEC4 ECS

Following on from the discussion of Option W1 in the last course, this course looks at Option W2. This is used for contracts which are the subject of the Housing Grants Construction and Regeneration Act 1996 (as amended).

It is, therefore, primarily used in the UK.  It may also be used for other contracts if so chosen, but Parties should be familiar with the effects that using this clause will have on their rights and obligations.

There are a number of similarities between Options W1 and W2, so this course will repeat a number of the points made in the last course.  However, there are some differences, particularly in timings at which steps are mandatory, so please pay careful attention to the changes.

After completing this course, you should:

  1. Understand the differences between Options W1 and W2
  2. Know the basics of how the adjudication process works
  3. Be familiar with when and how a dispute may be referred to the Adjudicator and the tribunal
