An Overview of Adversarial Dispute Resolution (Part 2) Arbitration

The aim of this course is to describe the process of adjudication and also the more traditional mechanisms to resolve disputes using arbitration and litigation, considering in particular the relative merits of the latter two as means of achieving a final solution to a construction dispute.

After studying this course, you should be able to:-

1. Qualify how arbitration is a procedure for the resolution of disputes which is, for the most part, under the control of the parties.
2. Explain how the nature of arbitration, the arbitrator's jurisdiction, arbitration procedure under the 1996 act, control by the courts and challenging an arbitrator's award can impact on proceedings.
