NEC3 PSC Consultant Submission Template

Use this free downloadable template to help you create a Consultant Submission and Submissions for Acceptance under the NEC3 Professional Services Contract (PSC) 

The PSC requires the Consultant to make submissions to the Employer on various matters that arise during the course of a construction project. The PSC goes a step further than most traditional contracts by requiring the Employer to not only respond to a submission, but to respond with reasons. A reason outside those listed in the contract will be a compensation event.

You can use this NEC3 PSC template for a Consultant’s submission of the following: -

• Submit under clause 21.3 forecasts of total expenses for the whole of the services (main Option A)
• Submit under clause 21.4 forecasts of total Time Charge for the whole of the services (main Options C, E and G)
• Submit under clause 22.1 for acceptance details of a replacement person (period for reply is period for reply)
• Submit under clause 23.1 provision of information to Others
• Submit under clause 24.2 for acceptance the name of a proposed subconsultant (period for reply is period for reply)
• Submit under clause 24.3 for acceptance proposed subcontract documents (period for reply is period for reply)
• Submit under clause 24.4 for acceptance proposed contract data for each subcontract (main Options C and E) (period for reply is period for reply)
• Submit under clause 25.1 a request for approval from Others
• Submit under clause 34.1 a quotation for acceleration
• Submit under clause 34.2 reasons for not submitting a quotation for acceleration
• Submit under clause 40.2 a quality management system for acceptance (period for reply is period for reply)
• Submit under clause 53.2 for acceptance a revised activity schedule (main Option A and C) (period for reply is period for reply)
• Submit under clause 81.2 a request to provide certificates of insurance
• Submit under clause 81.2 certificates of insurance
• Submit under clause 91.2 information resulting from work carried out to date
• Submit under clause X4.1 a parent company guarantee
• Submit under clause X9.1 documents which transfer rights to the Employer
• Submit under clause X13.1 for acceptance details of a bank or insurer to provide a performance bond (period for reply is period for reply)
• Submit under clause X13.1 a performance bond
• Submit under clause X20.2 a report of performance
• Submit under clause X20.3 proposals for improving performance
• Submit under clause Y1.4 for acceptance details of the banking arrangements for the Project Bank Account (period for reply is period for reply)
• Submit under clause Y1.4 copies of communications with the Project Bank
• Submit under clause Y1.6 for acceptance a proposal to add a Supplier to the Named Suppliers (period for reply is period for reply)
• Submit under clause Y1.9 the Authorisation setting out sums due to the Named Suppliers

For simplicity, you can use this template for a ‘report’ under clause X20.2, ‘gives’ under X4.1, and X13.1, and a ‘provision’ under clauses 25.1, 81.2, 91.2 and Y1.4.
