Part 1: What are JCT contracts? (Free)

The aim of this course is to provide an overview of the JCT contracts with a focus on the SBC.

After studying this course, you should be able to:

  1. Understand what contracts are in the JCT Suite
  2. Explain the differences between the JCT 2016 SBC contract
  3. Learn how the contract is made
  4. Understand the various documents that comprise the contract 

Part 2: The personalities and communication (Free)

The aim of this course is to understand the different personalities identified in the Contract, along with their roles and responsibilities and methods of communication.

After studying this course, you should be able to:

  1. Identify the personalities named in the Contract
  2. Explain their roles and the limits of their powers
  3. Understand how the contract deals with communications
  4. Learn the importance of communications in JCT contracts

Part 3: Access, subcontracting, instructions and safety (Free)

The aim of this course is to understand limits on access to the site by others, the subcontracting process, compliance with instructions and the contractual requirements surrounding safety.

After studying this course, you should be able to:

  1. Understand who has access to the site
  2. Explain the process surrounding the appointment of subcontractors
  3. Understand the Architect/Contract Administrator’s powers to issue instructions
  4. Outline the obligations of the parties in connection with health and safety.

Part 4: Carrying out the work, documentation, quality and defects

The aim of this course is to understand the Contractor’s obligations surrounding the quality of the work.

After studying this course, you should be able to:

  1. Identify which documents describe the scope of the works
  2. Outline the requirements regarding workmanship and materials
  3. Understand the definition of a ‘defect’ and how the contract requires them to be remedied

Part 5: Possession, progress, completion and lateness

The aim of this course is to provide an overview of how the JCT SCB 2016 deals with time and progress.

After studying this course, you should be able to:

  1. Understand the obligations of the parties in connection with possession of the site
  2. Explain how the contract requires the Contractor to properly progress the works
  3. Understand the definition of completion
  4. Learn about the consequences of late completion.

Part 6: Extension of Time

The aim of this course is to understand the extension of time provisions.

After studying this course, you should be able to:

  1. Understand the need to issue proper delay notices
  2. Explain the Relevant Events
  3. Outline the process to extend the Completion Date.

Part 7: Insurance

The aim of this course is to outline the insurance provisions of the contract.

After studying this course, you should be able to:

  1. Understand the party’s liabilities surrounding insurable risks
  2. Explain the difference between liability and insurance
  3. Outline the various insurances required by the parties.

Part 8: Assignment, bonds, warranties, third party rights and termination

The aim of this course is to understand various miscellaneous provisions regarding third parties and termination of the Contractor’s employment.

After studying this course, you should be able to:

  1. Understand what is meant by assignment, bonds and warranties
  2. Explain how third parties can exercise rights
  3. Outline the termination provisions
  4. Understand the need to properly issue the termination notices.

Part 9: Variations

The aim of this course is to understand the contractual mechanisms dealing with variations.

After studying this course, you should be able to:

  1. Define ‘Variation’
  2. Explain what is meant by a ‘variation quotation’
  3. Understand the ‘Valuation Rules’.

Part 10: Payment

The aim of this course is to understand the methods by which the Contractor is paid

After studying this course, you should be able to:

  1. Define the Contract Sum
  2. Outline the payment process
  3. Explain how relevant legislation can impact that process.

Part 11: Loss and Expense

The aim of this course is to outline the various contractual provisions dealing with reimbursing the Contractor for costs incurred due to delay and disruption.

After studying this course, you should be able to:

  1. Understand the need to issue proper notices
  2. Explain the Relevant Matters
  3. Outline the process to assess the correct amount of loss and expense.

Course 12: Claims and dispute resolution

The aim of this course is to understand how the contract deals with claims and how disputes are resolved.

After studying this course, you should be able to:

  1. Explain typical matters which can be the subject of a claim
  2. Identify the procedure for taking a claim to the dispute resolution process
  3. Outline the various dispute resolution methods in the contract.
