An Introduction to Defective Buildings for Owners (Part 1)

Defects are aspects of the works that are not in accordance with the contract. Defects may occur because of design deficiencies, material deficiencies, specification problems and workmanship deficiencies. Some defects maybe latent defects (hidden) because of the nature of the construction. Latent defects are those which cannot be discovered by reasonable inspection, for example problems with foundations which may not become apparent for several years after completion when settlement causes cracking in the building. The aim of this course is to explain the legal rights of building owners and describe the remedies that they may have if a defect comes to light after they has acquired the building.

After studying this course, you should be able to:-

1. Explain some of the intricacies of both claims in negligence and the law, it's development, including any exceptions.
2. Outline how the Defective Premises Act 1912 offers at least a partial solution to defective buildings owned by subsequent owners, and other statutory remedies.
